| 本論文は，精神障害者を対象としたインフォームドコンセント，インフォームドアセントを整理し，インフォームドアセントはどのようにあるべきかを整理することを目的とした．子どものインフォームドアセントや認知症者，精神障害者のインフォームドアセントに関する文献レビューを踏まえ，原則的には精神障害者であっても同意能力があればインフォームドコンセントが行われる必要があることが整理できた．また，同意能力がない場合には，法的な制約はないが，インフォームドアセントを行うことで精神障害者の自己決定を推進，保障する必要がある．なお，同意能力がないとされる子どもへの同意，意思決定と，精神障害による説明の理解，判断，決定，意思表明という一連の活動を参考に，精神障害者のインフォームドコンセント及びインフォームドアセントを行うために評価項目の整理や，評価のためのツールの開発が必要である．また，評価を基にした手順を精神障害者と共に創ることの重要性が確認できた． | ||||||||

| This paper aims to clarify informed consent and informed assent for persons with mental disabilities and discussed how such consent should be conducted. Based on a review of the literature on informed consent and informed assent for children, individuals with dementia and individuals with mental disabilities, we concluded that, in principle, informed consent must be given to individuals with mental disabilities if they have the capacity to provide consent. In the absence of capacity to consent, there are no legal restrictions; however, informed assent is necessary to promote the self-determination of individuals with mental disabilities. In addition, it is necessary to organize evaluation items and develop tools for evaluation to provide informed consent and informed assent to persons with mental disabilities, referring to the series of activities of consent and decision-making for children who are considered to lack the capacity to consent, understanding, judgment, decision-making, and declaration of intention of explanation due to mental disabilities. In addition, the study confirmed the importance of creating procedures based on the evaluation of individuals with mental disabilities. | ||||||||
