| 我が国においては,法案を提出できるのは内閣及び国会議員である.このうち,ほとんどの法案は内閣提案であるが,一方で重要な法案が議員提案という形で提出されている例もある.その例の一つが「臓器の移植に関する法律」(平成9年法律第104号)であり,衆議院より議員提案として提出されたものである. この法案は,国会提出後,2度の修正が行われたのち成立した.国会における修正の過程において,この法案は複雑化し,いくつかの問題もかかえている. しかし,多方面からの議論も多く,政治的にはあまり重要性がないと判断されたこうした法案については,内閣は当初から自ら提出する意思は持っていなかった.その中で,この法案が議員提案によって提出され,成立したことは,内容に多少の批判はあったとしても議員提出法案の大きな成果であり,国会の立法活動という面からも大きな意義があると考えられる. | ||||||||

| In Japan, both the Cabinet and members of the National Diet have the right to submit bills. In the majority of cases bill is submitted by the Cabinet, however on occasion, some important bill is submitted by Diet members. One such example was The Organ Transplantation Law, established in 1997. From the very beginning, the Cabinet never had any intension of submitting this legislation due to its tinderbox nature and its perceived lack of political weight. After submission to the Diet it went through two revisions, showing it to be both a highly complex and problematic piece of legislation. Given such a climate, the fact that it was submitted by Diet members and, even though it received a fair amount of criticism, was passed can be regarded as a major success. Furthermore, it had wider significance, as a positive example of legislative change brought about by members of the Diet. | ||||||||
