| 知的財産権の金融担保としては,質権設定について明文規定があるものの,「特許(等)を受ける権利」について設定不可能である点,担保権者が私的実行を行えない点等の欠点があり,実際にはあまり利用されていない.各担保権を比較検討した結果,知的財産権の金融担保化に際し,当事者や第三者との関係を中心になお検討の余地はあるものの,現時点では譲渡担保の採用が最も合理的であると結論付けられる.ただし,知的財産権の譲渡担保に不足し,かつ担保に求められる機能のうち,特に優先弁済機能を満足させるためには,知的財産権の流通性の向上,ひいては市場の確立が必要不可欠である. | ||||||||

When a financial mortgage of a intellectual property right is considered, the adoption of the mortgage by transfer is the most reasonable at the present time. However, it is necessary to research more fully the relationship between the person concerned and the third party. To satisfy the priority payoff function that runs short in the mortgage by transfer of the intellectual property right, the circulation of the intellectual property right must be improved, the establishment of its market will then be necessary and, consequently, indispensable." | ||||||||
