|
児童虐待やいじめ，貧困等，子どもとその家庭を取り巻く諸課題の多くは，子どもの権利を侵害している状況にあり，それらの事象は増加もしくは，多様化している現状にある．令和5年4月に「こども基本法」が施行され，子どもの権利施策は，医療，保健，福祉，教育，療育に至るまで，幅広く，整合性をもって実施されることとなった．そこで，総合的な子どもの権利施策を実施するために本研究では，ホワイトハウス会議から子どもの権利条約に至るまでの子どもの権利の変遷について，各条約と宣言を整理することを目的とした．その結果，子どもの権利条約以前は，受動的権利が中心であったが，子どもの権利条約で能動的権利が明文化された．それに伴い，いわゆる4つの一般原則のうち，能動的権利となる「意見表明権」について着目されることが多いが，児童労働や貧困，家庭や保育・教育に関連する条項は子どもの権利の中に途切れることなく含まれている．時代は変化したものの，未だ根強く残る課題があること，その支援が求められていることを忘れてはならない．子どもの権利条約は，それ以前の宣言や規約よりも批准国が多く，それぞれの社会・文化的状況に配慮された内容となっている．子どもの権利保障においては，国際基準に照らし合わせつつも，日本の文化や思想，法制度等に留意しなくてはならない． |

Many issues affecting children and their families, such as child abuse, bullying, and poverty, violate children’s rights, with the number of such cases increasing and diversifying. The Basic Act on the Rights of the Child, enacted in April 2023, has led to consistent and widespread implementation of children’s rights measures across a range of sectors including medical care, health, welfare, education, and rehabilitation. This study aimed to organize key treaties and declarations on children’s rights from the White House Conference to the Convention on the Rights of the Child. The findings reveal that prior to the Convention on the Rights of the Child, passive rights were the main focus, but the Convention on the Rights of the Child explicitly defined active rights. Among these, the so-called four general principles, the“ right to express opinions” is emphasized as one of the four general principles. However, the Convention also encompasses comprehensive rights related to child labor, poverty, family, childcare, and education. Although times have changed, we must not forget that there are issues that still persist and that support is still required. The Convention on the Rights of the Child has been ratified by more countries. To ensure children’s rights are upheld, it is essential to align with international standards while being mindful of Japan’s unique culture, legal system, and ideology. |
